ELECTRONIC MISSIVES WILL SOON BE HERE!

Stewart Brymer"The pace of change in the practice of conveyancing over the course of the past few years has been dramatic. New technological developments present fantastic opportunities for practitioners especially when coupled with changes in the law. One such change will be the e-enabling of conveyancing deeds in general and missives in particular. When that happens, we will, quite literally, be operating in a brave new world. Article 9 of an E-Commerce Directive from 2000 has still not been transposed into UK law however. It is anticipated that this will be done in the forthcoming Land Registration (Scotland) Bill. The sooner this happens the better and we can all move on from debating whether or not it is possible to conclude missives by fax, let alone by email. Solicitors should keep abreast of changes such as those being developed by the Yooseful team and be ready to take advantage of these developments."

HOW IT WORKS

Yooseful Technology provides web-based platforms for solicitors to send and receive offers for residential property in Scotland.

Having noted their interest, purchasing solicitors are invited to submit their offer, at no cost, through the Yooseful platform.

Offers are written onto a password-controlled database rather than faxed or emailed, eliminating the risk of a fax sent to a wrong number or an email failing to deliver in a timely fashion.

Currently offers are followed up in writing.

Several leading firms have already started subscribing and are using the systems in a live environment. To date more than 200 solicitors have interacted with our systems.
